Administrative Measures of Shenzhen Municipality on Special Funds for the Development of Modern Logistics Industry

Chapter I General Provisions

  Article 1 In order to further promote the development of Shenzhen's modern logistics industry, these Measures are formulated in accordance with the documents of the State Council's Plan for Adjustment and Revitalization of the Logistics Industry, the Medium-and Long-term Plan for the Development of the Logistics Industry (2014-2020) and the 13th Five-Year Plan for Shenzhen's Modern Logistics Industry, and in combination with the actual situation of this Municipality.

  Article 2 The term "Special Funds for the Development of Shenzhen's Modern Logistics Industry" (hereinafter referred to Special Funds) as mentioned in these Measures refers to the special funds established by the municipal government for the purpose of adjusting and optimizing the economic structure, accelerating the construction of an international logistics hub city, improving the service quality and comprehensive competitiveness of Shenzhen's logistics industry, and further consolidating the pillar position of the logistics industry.

  Article 3 The management and use of special funds shall adhere to the principle of "openness, fairness, and impartiality" and implementing the system of "enterprise declaration, social publicity, government decision-making and performance evaluation".

  Article 4 Special funds are divided into the following subitems:

  (1) Logistics subitem; the scope of funding includes discount interest funding project for municipal key logistics enterprises, lump-sum reward project for municipal key logistics enterprises, lump-sum funding project for municipal public information service platform for logistics, pure electric logistics distribution vehicle operation funding project and smart express box funding project.

  (2) Aviation industry subitem; the scope of funding includes the funding project for base airlines launching a new freight route at Shenzhen Airport, funding project for non-base airlines and charterers launching a new freight route at Shenzhen Airport, funding project for base airlines launching new domestic passenger destinations at Shenzhen Airport, funding project for non-base airlines and charterers launching new domestic passenger destinations at Shenzhen Airport, funding project for air freight forwarders handling cargo ranking, funding project for "Shenzhen Flying" passenger travel services and publicity, funding project for airlines launching new international passenger destinations at Shenzhen Airport.

  (3) Port and shipping subitem; the scope of funding includes green ports (including river-to-river transfer funding project and sea-rail intermodal transport funding project), international shipping hubs (including funding projects for international liner companies, international freight forwarders, and waterway transport enterprises), and waterborne passenger transport (including funding project for cruise ship operation and domestic passenger transport).

  (4) China (Shenzhen) International Logistics and Transportation Fair (hereinafter referred to as the CILF) subitem; the scope of funding includes the CILF government conference funding projects, CILF booth fee funding projects.

  (5) Other projects approved by the Shenzhen Municipal Government.

  Article 5 The special funds shall be arranged by the budget of the financial year. In principle, the total amount of annual subsidy shall not exceed RMB 955 million (excluding the budget for the projects financed under Article 11 (7)), and the actual amount of funding shall be subject to the annual budget. The Municipal Transport Commission may adjust the total amount of the special funds budget according to the national strategy, the deployment of higher authorities and the new requirements of the industrial development for the logistics industry of our city, and in accordance with the relevant provisions of the management of project library.

Chapter II Management Responsibilities and

Division of Work

  Article 6 The Municipal Finance Commission is the fund management department of special funds, which shall undertake the following responsibilities:

  (1) Be responsible for participating in the formulation of the implementing rules and operating procedures that are complementary to the management methods.

  (2) Be responsible for reviewing the annual budget of special funds, organizing and coordinating the budget preparation of special funds, as well as the overall scheduling and overall arrangement of special funds.

  (3) Be responsible for organizing and implementing financial supervision and overall performance evaluation of special funds, inspecting the performance evaluation of the competent business departments, and carrying out key performance evaluation or re-evaluation of the performance of special funds expenditure as required.

  (4) Other affairs within the scope of their functions.

  Article 7 The Municipal Transport Commission is the competent department in charge of the business with special funds, and shall undertake the following responsibilities:

  (1) Be responsible for establishing and improving the specific management system of special funds, including formulating supporting implementing rules and operating procedures, improving the internal management system, and strengthening internal supervision, etc.

  (2) Be responsible for the application of adjustment of special funds, compiling the special funds budget and project expenditure plan of the department, and implementing the approved special funds budget and project expenditure plan.

  (3) Be responsible for establishing the project database and project reserve according to the policy of the municipal government, accepting and reviewing the application of specific projects, handling the allocation of funds, and being responsible for the safety of the use of special funds.

  (4) Be responsible for organizing the acceptance of the project, tracking and inspecting the use of the special funds and the implementation of the project; be responsible for the performance evaluation of the special funds of the department, and cooperate with the Municipal Finance Commission to re-evaluate the performance.

  (5) Be responsible for the disclosure of information on special funds.

  (6) Be responsible for the renewal evaluation and the relevant renewal procedures of the special funds that need to be renewed; liquidation, capital recovery and other related follow-up management of the special funds upon expiration or cancellation of the remaining period.

  (7) Other affairs within the scope of their functions.

  Article 8 Units using special funds shall mainly undertake the following responsibilities:

  (1) Be responsible for the authenticity and legality of the application materials.

  (2) Implement the project implementation conditions and supporting funds, and set performance targets.

  (3) Use special funds in accordance with relevant regulations, ensure the safety of funds, and carry out standardized financial management and accounting for special funds.

  (4) Provide the report on the implementation of the project and supporting materials as required, and accept the supervision, inspection and acceptance by relevant departments.

  (5) Provide reports on the use of special funds, relevant financial statements and annual final accounts as required, and accept the supervision, inspection and audit of the use of special funds by relevant departments.

  (6) Cooperate with the project performance evaluation, and provide the project materials and other relevant materials required by the Municipal Transport Commission and the Municipal Finance Commission for performance evaluation.

  (7) Cooperate with relevant departments in other work related to the management of special funds.

  Article 9 Audit and supervision departments shall be responsible for supervising, supervising and auditing the use and management of special funds.

  Chapter III Objects, Conditions and Standards of Funding

  Article 10 Subjects, conditions and standards of funding for logistics subitem

  (1) Discount interest funding projects for key logistics enterprises of the Municipality.

  1. Conditions of application

  (1) The applicant enterprises are identified according to the Administrative Measures of Shenzhen Municipality on the Recognition of Key Logistics Enterprises, and it is a key logistics enterprise of the Municipality within the period of financial aid review;

  (2) The enterprise carries out the main business, that is, the production and operation, construction and transformation of logistics facilities, the purchase of logistics equipment and loans from the bank, as well as the factoring of supply chain management business, the launch of letters of credit, the processing of commercial acceptance bills, which generate interest accordingly.

  2. Funding criteria

  The interest generated from the main business of the municipal key logistics enterprises of the previous year on the date of application shall be subsidized with discount interest, the amount of which shall not exceed 50% of the bank interest actually paid by the enterprises during the review period of funding, and the maximum amount of discount interest per enterprise shall not exceed RMB 3 million.

  (2) Lump-sum reward projects for key logistics enterprises of the Municipality.

  1. Conditions of application

  Key logistics enterprises of Shenzhen Municipality first identified according to the Administrative Measures of Shenzhen Municipality on the Recognition of Key Logistics Enterprises.

  2. Funding criteria

  Each enterprise shall be given a lump-sum reward of no more than RMB 300,000.

  (3) Lump-sum funding projects of the municipal public information service platform for logistics.

  1. Conditions of application

  The municipal public information service platform for logistics project is identified according to the Detailed Rules for the Implementation of the Project Recognition of Shenzhen Municipal Public Information Service Platform for Logistics.

  2. Funding criteria

  It is a lump-sum fund, and the approved projects shall be funded annually. The amount shall not exceed 30% of the total actual investment during the review period, and each project shall not exceed RMB 2 million.

  (4) Pure electric logistics distribution vehicle operation funding project.

  1. Conditions of application

  The applicant enterprises shall meet the following requirements:

  (1) Registered in Shenzhen and has independent legal personality;

  (2) Obtain the road transport operation license issued by the municipality competent department of road transport;

  (3) There shall be no less than 300 freight vehicles that meet the Technical Requirements for Selection of Vehicles for Urban Logistics Distribution (GB/T29912-2013) and obtain the valid road transport certificate issued by the municipal competent department of road transport, among which no less than 100 pure electric logistics distribution vehicles shall be included in the Catalogue of Recommended Models for New Energy Vehicle Promotion and Application Project issued by the Ministry of Industry and Information Technology; or no less than 50 pure electric refrigerated vehicles and pure electric container tractors shall be included in the Catalogue of Recommended Models for New Energy Vehicle Promotion and Application Project of the Ministry of Industry and Information Technology.

  Vehicles applying for financial assistance should meet the following conditions:

  (1) It is included in the Catalogue of Recommended Models for New Energy Vehicle Promotion and Application Project of the Ministry of Industry and Information Technology and meets the technical requirements of the state-subsidized new energy trucks;

  (2) Registered with the municipal public security traffic police department for the first time after January 1, 2017;

  (3) Obtain a valid road transport certificate issued by the municipal competent department of road transport;

  (4) During the review period, the vehicles have been connected to the supervision platform of the pure electric logistics distribution vehicles of the Municipal Transport Commission as required, and the driving mileage in Shenzhen has reached 15,000 km/year.

  2. Funding criteria

  The amount shall be calculated according to the total storage capacity of the power battery that provides the driving power by means of piecewise excess regression, and the fund shall be distributed evenly over three years. Vehicles that meet the operation standards can be funded in the current period, while vehicles that do not meet the operation standards cannot be funded in the current period.

  Total battery storage capacity: RMB 750 per kWh for 30 (inclusive) kWh or less; RMB 600 per kWh for 30-50 (inclusive) kWh; RMB 500 per kWh for 50kWh and above. The total funding amount for cycling for three years shall not exceed RMB 75,000.

  (5) Smart Express Box Funding Project.

  1. Conditions of application

  (1) An enterprise that has been registered in Shenzhen for more than 3 years and with business of research, development, construction or operation of the smart express box.

  (2) More than 200 sets of smart express boxes were newly built and put into operation in the previous year on the date of application.

  2. Funding criteria

  The newly-built smart express box within the review period shall be given a lump-sum fund according to the standard of RMB 3000/group, and the total annual fund of a single enterprise shall not exceed RMB 900,000.

  Article 11 Subjects, conditions and standards of funding for aviation industry subitem

  Base airline refers to the airline whose headquarters is registered in Shenzhen, or the subsidiary or branch of the airline whose headquarters is not located in Shenzhen but its operation support base is in Shenzhen.

  Non-base airlines are airlines other than base airlines operating at Shenzhen Airport.

  The charterer refers to the legal person or natural person who leases the aircraft staffed with the crew from the airline and opens the passenger and cargo routes at Shenzhen Airport.

  The new cargo route refers to the cargo route opened by the airline (charterer) at Shenzhen Airport, which has never been operated by the company (charterer).

  The new passenger destination is an airport that meets one of the following conditions: (1) There are no passenger flights from Shenzhen Airport to the airport within 2 years prior to the date of departure; (2) Although there are passenger flights to Shenzhen Airport within 2 years before the departure date, the flights have been suspended and less than 50 outbound flights have been completed by any airline within 2 years.

  (1) Funding project for the base airlines launching new freight routes at Shenzhen Airport.

  1. Conditions of application

  Base airlines has launched new cargo routes and operated for more than one year at Shenzhen Airport, with departures from Shenzhen Airport of more than 50 flights within one year.

  2. Funding criteria

  A lump-sum fund shall be given according to the total cargo volume of the route at Shenzhen Airport. Among them: the funding standard for international routes is RMB 1000/ton, and the total funding amount for each route does not exceed RMB 10 million; the funding standard for domestic airlines is RMB 500/ton, and the total funding amount for each airline shall not exceed RMB 5 million.

  (2) Funding project for the non-base airlines and charterers launching a new freight route at Shenzhen Airport.

  1. Conditions of application

  Non-base airlines and charterers have launched new cargo routes and operated for more than one year at Shenzhen Airport, with departures from Shenzhen Airport of more than 50 fights within one year.

  2. Funding criteria

  A lump-sum fund shall be given according to the total cargo volume of the route at Shenzhen Airport. The funding standard is: RMB 500/ton for international airlines, and the total funding amount for each airline shall not exceed RMB 5 million; RMB 300/ton for domestic routes, and the total funding amount for each route shall not exceed RMB 3 million.

  (3) Funding project for the base airlines launching the new domestic passenger destinations at Shenzhen Airport.

  1. Conditions of application

  Base airlines has launched the new domestic passenger destination at Shenzhen Airport and operated for more than one year, with departures from Shenzhen Airport of more than 100 fights within one year.

  2. Funding criteria

  A lump-sum fund of no more than RMB 5 million shall be given for each new destination opened.

  (4) The funding project for non-base airlines and charterers launching the new domestic passenger destinations at Shenzhen Airport to support the project.

  1. Conditions of application

  Non-base airlines and charterers have launched and operated the new domestic passenger destination at Shenzhen Airport for more than one year, with departures from Shenzhen Airport of more than 100 fights within one year.

  2. Funding criteria

  A lump-sum fund of no more than RMB 3 million shall be given for each new destination opened.

  (5) Funding project for the ranking of cargo handling capacity of air freight forwarding enterprises.

  1. Conditions of application

  Air freight forwarders registered in the city, and annual processing of international and domestic cargo (excluding mail) at Shenzhen Airport ranked in the top 5.

  2. Funding criteria

  Funds shall be provided according to the outgoing cargo volume of the agent (excluding mail). Among them, the international outgoing cargo volume ranked in the top 5, the funding standard is RMB 200/ton, the funding ceiling is: no more than RMB 1.5 million for the first place, no more than RMB 1.2 million for the second place, no more than RMB 900,000 for the third place, no more than RMB 700,000 for the fourth place, no more than RMB 500,000 for the fifth place; the domestic outgoing cargo volume ranked in the top 5, with the funding standard of RMB 50/ton. The funding ceiling is: no more than RMB 1.5 million for the first place, no more than RMB 1.2 million for the second place, no more than RMB 900,000 for the third place, no more than RMB 700,000 for the fourth place, and no more than RMB 500,000 for the fifth place.

  This fund shall not apply to charterers or agents directly affiliated to or stock-held by an airline.

  (6) "Shenzhen Flying" passenger travel services and publicity and publicity funding projects.

  1. Conditions of application

  Enterprises providing "Shenzhen Flying" passenger travel services, carrying out "Shenzhen Flying" publicity and promotion.

  2. Funding criteria

  Relevant enterprises shall submit the annual work plan to the Municipal Transport Commission in accordance with the requirements of the "Shenzhen Flying" passenger travel service and publicity and promotion funding project, and carry out the work according to the plan. Upon completion of the work, the application materials for financial aid shall be submitted uniformly to the Municipal Transport Commission on schedule, and the Municipal Transport Commission shall review the objects and amount of financial aid.

  (7) Measures for the funding of projects for the launch of new international passenger destinations at Shenzhen Airport by airlines shall be formulated separately.

  Article 12 Subjects, conditions and standards of funding for port and shipping industry subitem

  (1) Green ports.

  1. River-to-River Transfer Funding Project

  (1) Conditions of application

  Operating companies engaged in foreign trade inland branch line (including Hong Kong, Macao, and Taiwan) transportation or domestic trade route transportation, which have completed container loading and unloading of more than 5000 TEU (inclusive) in Shenzhen Port in the year of review. The review year is the year preceding the date of application.

  (2) Funding criteria

  Funds shall be provided in accordance with the loading and unloading volume completed in Shenzhen Port in the year review. Among them, the funding standard of foreign trade internal branch line is RMB 50/TEU, and the funding standard of the domestic trade route is RMB 30/TEU.

  2. Sea-rail intermodal transport funding project

  (1) Conditions of application

  The operating company engaged in sea-rail intermodal transport in Shenzhen Port. The review year is the year preceding the date of application.

  (2) Funding criteria

  Offer fund according to the container volume completed by sea-rail intermodal transportation in the examination year, among which: the funding standard in the province is RMB 200/TEU; the inter-provincial funding standard is RMB 300/TEU.

  (2) International shipping hubs.

  1. International liner company-funded projects

  (1) Conditions of application

  International liner companies that have completed loading and unloading of foreign trade containers in Shenzhen Port exceeding 20,000 TEU (inclusive) within the year of review. The review year is the year preceding the date of application, in which the newly-added liner routes shall be operated for more than one year (inclusive).

  (2) Funding criteria

  ① The newly-added boxes shall be funded according to RMB 50/TEU, and the funding amount of each company shall not exceed RMB 5 million;

  ② The top 20 contributors of throughput should be funded, and the funding standard shall be: RMB 1 million for the 1st to 5th place respectively; RMB 800,000 for the sixth to tenth place respectively; RMB 600,000 for the 11th to 15th place respectively; RMB 400,000 for the 16th to 20th place respectively; calculation method of contribution: loading and unloading capacity rank × K1 + combined port water transfer capacity rank × K2 + new liner route number × K3. (For the newly added container liner routes along the Maritime Silk Road in the review year, the contribution score of the company shall be calculated as 1.5 times regardless of the newly added quantity of 1 or more)

  Ranking value: 20 for No.1, 1 for No.20, and so on; K value: K1=0.4, K2=0.4, K3=0.2, K1+K2+K3=1.

  ③ The empty boxes transferred from Shenzhen Port to the combined port shall be funded according to RMB 40/TEU.

  2. International Freight Forwarders Funding Project

  (1) Conditions of application

  International freight forwarders registered in Shenzhen, and the foreign trade box volume is more than 2000 TEUs in the review year. The review year is the year preceding the date of application.

  (2) Funding criteria

  ① The newly-added import heavy boxes shall be funded according to RMB 20/TEU, and the newly-added export heavy boxes shall be funded according to RMB 60/TEU. The funding amount for each company shall not exceed RMB 1 million;

  ② The top 50 in comprehensive scoring should be funded according to the following criteria: RMB 1 million for the 1st to 5th place respectively; RMB 800,000 for the 6th to 15th place respectively; RMB 600,000 for the 16th to 30th place respectively; RMB 400,000 for the 31st to 50th place respectively;

  Calculation method of comprehensive scoring: Ranking of import and export heavy boxes × K1 + Ranking of sea-rail combined transportation boxes × K2.

  Ranking value: 50 for No.1, 1 for No.50, and so on; K value: K1=0.7, K2=0.3, K1+K2=1.

  3. Funding project for waterway transport enterprises

  (1) Conditions of application

  A waterway transportation enterprise registered in Shenzhen. The review year is the year preceding the date of application.

  (2) Funding criteria

  ① The newly-added operating ships of "Shenzhen" port of registry shall be funded according to RMB 60/gross ton;

  ② The top 10 in the comprehensive scoring system should be funded by the following criteria: RMB 3 million for the 1st place; RMB 2 million for the 2nd to 3rd place respectively; RMB 1.5 million for the 4th to 6th place respectively; RMB 1 million for the 7th to 10th place respectively.

  Calculation method of comprehensive scoring: load tonnage ranking × K1 + total tax revenue ranking × K2.

  Ranking value: 10 for No.1, 1 for No.10, and so on; K value: K1=0.5, K2=0.5, K1+K2=1.

  If the funded ship fails to cancel the registration within 5 years, it shall return the obtained funds if it violates its commitment.

  (3) Passenger transport by waterway.

  1. Cruise operation funding project

  (1) Conditions of application

  A dock company that operates a cruise port in Shenzhen. The review year is the year preceding the date of application.

  (2) Funding criteria

  ① Fund for the voyage. The fund for homeport cruise ships and international visiting cruise ships is classified according to the tonnage of the cruise ships. Each arrival and departure of cruise ship shall be deemed as one voyage, with the departure time taken as the criterion. The detailed classification is as follows:

  Category A cruise ships (less than 70,000 gross tons): within 20 voyages (inclusive), funding RMB 200,000/voyage; the 20th voyage or above, funding RMB 250,000/voyage.

  Category B cruise ship (over 70,000 gross tons -100,000 gross tons (inclusive)): within 20 voyages (inclusive), funding RMB 250,000/voyage; the 20th voyage or above, funding RMB 300,000/voyage.

  Category C cruise ships (over 100,000 gross tons): within 20 voyages (inclusive), funding RMB 300,000/voyage; the 20th voyage or above, funding RMB 350,000/voyage. For short-haul homeport routes or dual homeport routes for 3 days, 2 nights or less, the funding standard is 50%.

  ② Fund for cruise passengers.

  If the annual outbound passenger flow is less than 150,000, the fund shall be given according to RMB 270/person-time;

  If the annual outbound passenger flow is from 150,000 (inclusive) to 200,000, the fund shall be given according to RMB 220/person-time;

  If the annual outbound passenger flow is from 200,000 to 250,000, the fund shall be given according to RMB 180/person-time;

  If the annual outbound passenger flow exceeds 250,000 (inclusive), the fund shall be given according to RMB 150/person-time.

  2. Domestic passenger transport funding projects

  (1) Conditions of application

  Waterway passenger transport enterprises and terminals registered in Shenzhen. The review year is the year preceding the date of application.

  (2) Funding criteria

  ① The funding standard for newly launch the waterway passenger transport route from Shenzhen is RMB 3000/voyage (round trip, the same below) in the first year, RMB 2500/voyage in the second year and RMB 2000/voyage in the third year if the distance is within 30 nautical miles (inclusive). If the transportation distance is over 30 nautical miles and within 60 nautical miles (inclusive), RMB 6,000/voyage in the first year, RMB 5,000/voyage in the second year and RMB 4,000/voyage in the third year. If the transportation distance is over 60 nautical miles, RMB 9,000/voyage in the first year, RMB 7,500/voyage in the second year and RMB 6,000/voyage in the third year.

  ② If a new passenger destination or a new route is added in this Municipality, a lump-sum fund of 20% of the total investment in fixed assets shall be provided, and the funding amount for each passenger destination shall not exceed RMB 20 million.

  Article 13 Subjects, conditions and standards of funding for CILF subitem

  (1) CILF funds provided by the government.

  1. Conditions of application

  Government departments and their subordinate units that undertake relevant meetings, forums and activities of the CILF.

  2. Funding criteria

  In accordance with the Measures of Shenzhen Municipality for the Administration of Conference Expenses of Party and Government Organs and Institutions Directly under the Municipal Government and other relevant provisions, the total amount of project support fund shall not exceed RMB 4 million in principle.

  (2) Funding projects for booth fee of the CILF.

  1. Conditions of application

  Exhibitors participating in the CILF in the year of application.

  2. Funding criteria

  Individual exhibitors shall not exceed 50% of the booth fee, and the total amount of project funding shall not exceed RMB 10 million in principle.

  Article 14 In any of the following circumstances in Shenzhen, the special funds (excluding the funding for new international passenger destinations) shall not be supported:

  (1) Projects with the same contents have been supported or rewarded by other special financial funds of Shenzhen Municipality.

  (2) The enterprise has major operational road safety accidents and bears the main responsibility within the review year.

  (3) During the review year, the enterprise shall be subject to administrative penalty of more than RMB 50,000 (inclusive) for a single violation of laws and regulations in the local market supervision, state tax, local tax, customs, traffic and other departments, or be subject to administrative penalty of more than RMB 100,000 (inclusive) for a single violation of laws and regulations, or be included in the "blacklist" for dishonesty by the aforesaid departments. If the law enforcement department has specific provisions and explanations on the punishment results, such provisions and explanations shall prevail.

  (4) Being included in the list of abnormal business operations of the enterprise or the list of serious enterprises in violation of the law.

  Chapter IV Procedures for Organizing and Implementing Special Funds

  Article 15 The Municipal Transport Commission shall organize the project declaration work in accordance with these Measures and the identification methods, implementing rules and operating procedures of each funding subitem for modern logistics industry.

  Article 16 The Municipal Transport Commission shall, after organizing the review and evaluation of the projects declared by the enterprises (excluding the projects supported by the new international passenger destinations), determine the list of the enterprises receiving the annual funding and the amount of the funding, and publicize them to the public through the municipal newspapers and the portal websites of the Municipal Transport Commission, with a publicity period of 10 days. If there is any objection during the period of publicity, it shall not be listed as the object of funding for the time being, and the Municipal Transport Commission shall review the objection within 60 days from the date of receipt of the objection; if the objection is true, the enterprise shall be disqualified from receiving the fund.

  Chapter V Budget Preparation and Allocation of Special Funds

  Article 17 The Municipal Transport Commission shall, in preparing the departmental budget for the following year, incorporate the projects to be funded into the special fund budget in accordance with the budget management procedures. The Municipal Finance Commission shall examine the budget in accordance with the procedures and report to the Municipal People's Congress. The Municipal Finance Commission shall, after the annual budget is approved by the Municipal People's Congress, approve the special fund project together with the departmental budget to the Municipal Transport Commission.

  Article 18 The Municipal Transport Commission shall allocate funds in accordance with the relevant provisions of centralized treasury payment management.

  Chapter VI Management of the Use of Special Funds

  Article 19 Units using special funds shall strengthen the management of special funds and carry out separate accounting in accordance with the relevant financial systems of the State. Where government procurement is required, it shall be handled in accordance with the provisions on government procurement.

  Chapter VII Supervision and Inspection

  Article 20 The Municipal Transport Commission shall be responsible for the performance evaluation of the funding projects and submit the results of the performance evaluation in written form to the Municipal Finance Commission for the record. The Municipal Finance Commission shall take the lead in organizing the key evaluation or re-evaluation of the performance of the use of special funds.

  Article 21 Where an applicant repeatedly applies for special funds or applies for special funds with false materials, the Municipal Transport Commission shall recover the funds and order the applicant to carry out rectification and improvement, and placed on the "blacklist" of financial funds, and shall not accept the application for financial funds within three years. Whoever is suspected of committing a crime shall be transferred to a judicial organ for handling according to law.

  Article 22 If the entrusted third-party institution engages in fraudulent practices, concealment of the truth, collusion and cheating with the entity applying for the special fund, etc. during the review, evaluation, and audit of the projects and the funds, and the evidence is conclusive, the Municipal Transport Commission shall cancel the qualification of review, evaluation, and audit of the project and the funds. Meanwhile, relevant units shall deal with the units involved and the persons responsible according to law. Whoever is suspected of committing a crime shall be transferred to a judicial organ for handling according

  Article 23 If the experts participating in the review or evaluation make use of the review or evaluation to cheat or seek profits, their qualifications as experts shall be cancelled, their responsibilities shall be investigated in accordance with relevant provisions, and they shall be exposed in the news media. Whoever is suspected of committing a crime shall be transferred to a judicial organ for handling according to law.

  Article 24 Any administrative staff member of special funds who, in violation of these Measures, abuses his power, neglects his duty or engages in malpractices for personal gain in the management and supervision work shall be dealt with by the municipal financial and supervisory authorities in accordance with the law. Whoever is suspected of committing a crime shall be transferred to a judicial organ for handling according to law.

  Chapter VIII Supplementary Provisions

  Article 25 The administrative expenses of special funds shall be included in the annual departmental budget arrangements in accordance with relevant provisions.

  Article 26 The statistical indicators involved in these Measures shall be subject to the data identified by the municipal statistical department, and the relevant data shall be included in the scope of the statistical caliber of this Municipality. If the municipal statistical department does not have corresponding statistical indicators or data, the statistics of the competent departments of relevant industries shall prevail.

  Article 27 The Municipal Transport Commission and the Municipal Finance Commission shall be responsible for the interpretation of these Measures.

  Article 28 These Measures shall be implemented as of the date of promulgation and shall be valid for three years. The Administrative Measures of Shenzhen Municipality on Special Funds for the Development of Modern Logistics Industry (SCG (2013) No.12) shall be repealed at the same time from the date of promulgation of these Measures.
