To relevant units:

  In order to strengthen the market order of traffic utility maintenance projects in shenzhen, promote the awareness of integrity and self-discipline among the units and personnel engaged in relevant business activities in the field of maintenance of traffic utility in Shenzhen, standardize the behavior of maintenance project units and personnel, and promote the construction of credit system, we have hereby formulated the Credit Evaluation Management Methods for Traffic Utility Maintenance Projects in Shenzhen for compliance according to the Guiding Opinion of the State Council on Establishing and Perfecting the Joint Incentive and Punishment System for Keeping Faith and Speeding up the Construction of Social Credit, Opinions of the Ministry of Transport on Strengthening the Construction of Credit System in the Transport Industry, Notice of Guangdong Provincial People's Government on Printing and Distributing the Construction Plan (2014-2020) of Guangdong Social Credit System and Measures of Shenzhen Municipal on the Administration of Public Credit Information.

Credit Evaluation Management Methods for Traffic Utility Maintenance Projects in Shenzhen

Chapter I General Provisions

  Article 1 In order to standardize the market order of traffic utility maintenance projects in shenzhen, promote the sound development of the industry, strengthen the construction of credit system, we have formulated the Methods according to the Guiding Opinion of the State Council on Establishing and Perfecting the Joint Incentive and Punishment System for Keeping Faith and Speeding up the Construction of Social Credit, Opinions of the Ministry of Transport on Strengthening the Construction of Credit System in the Transport Industry, Notice of Guangdong Provincial People's Government on Printing and Distributing the Construction Plan (2014-2020) of Guangdong Social Credit System and Measures of Shenzhen Municipal on the Administration of Public Credit Information, and in light of the actual situation of the maintenance project market of traffic utility of shenzhen.

  Article 2 The Methods shall be applicable to the credit evaluation and management of the relevant units engaged in the maintenance of traffic utility in Shenzhen Municipal.

  Article 3 The municipal traffic and transport administrative department shall conduct credit evaluation on the units engaged in traffic utility maintenance projects by collecting relevant credit information and adopting quantitative methods in accordance with relevant laws and regulations, standards and norms, and contract documents.

  The municipal traffic and transport administrative department shall analyze and confirm the basic data collected, and the data with doubts or insufficient evidence shall be checked and confirmed before being used as the evaluation basis.

  Article 4 Credit evaluation shall follow the principles of openness, fairness, impartiality and good faith, and implement the system of publicity and announcement.

  Article 5 The content of credit information includes good behavior record and bad behavior record.

  The good behavior record refers to the credit information formed by all parties in the traffic maintenance market complying with the laws, regulations, standards, systems, practice rules and contract documents in the field of traffic facilities maintenance and other relevant fields, standardizing the activities, following good faith management, and consciously maintaining market order, and thus being awarded and rewarded by all levels of transportation departments, other relevant departments, and industry-related social organizations.

  The bad behavior record refers to the credit information formed by all parties in the traffic maintenance market violating the laws, regulations, standards, systems, practice rules and contract documents in the field of traffic facilities maintenance and other relevant fields, and thus being punished or criticized in the form of circulating the notice by all levels of transportation departments, other relevant departments, and industry-related social organizations.

  Article 6 The following information or materials may be used as the basis for credit evaluation:

  (1) Supervising, inspecting, rewarding, commending and punishing decisions made by the competent department of traffic and transportation or its quality (safety) supervision institution or other relevant government departments, as well as the situation announcement;

  (2) Official documents of the tenderee and the project legal person in their management;

  (3) Results of verified reports, complaints or investigation and handling of quality and safety accidents;

  (4) Decisions made by judicial organs and audit opinions of audit departments;

  (5) Relevant basic information and performance certification materials provided by the industry units;

  (6) Other legally effective instruments or valid supporting documents.

  The above information or materials shall be subject to the date of issuance or the time of confirmation of the credit evaluation year. If there is any act of breach of trust and there are sufficient evidential materials, such information or materials may be included in the evaluation year in which the act of breach of trust is discovered for evaluation.

  Article 7 The municipal traffic and transport administrative department shall be responsible for establishing a credit information management platform to realize the interconnection and effective sharing of credit information. The credit information of traffic facilities maintenance projects shall be dynamically updated according to the principles of collection, re-examination and renewal at any time.

  Article 8 The municipal traffic and transport administrative department shall calculate the preliminary evaluation results of annual credit evaluation and make them known to the public for a period of 10 working days according to the relevant information such as the credit information, the results of supervision and examination and the performance examination. After the announcement, if there is no objection to the official release, if there are objections within 10 working days after the receipt of objections to complete the processing, the results of the processing shall be replied in writing. The municipal traffic and transport administrative department has officially released the credit evaluation results of the annual traffic utility maintenance project units.

  Article 9 The credit evaluation cycle shall be one year, and the credit behavior of the industry unit in the previous year (from January 1 to December 31) shall be evaluated in the first half of each year (without accumulating the results of the previous cycle).

  Chapter II Credit Evaluation of Industry Units

  Article 10 The credit evaluation of the industry units engaged in the maintenance of traffic utility shall be subject to the deduction of points. The benchmark for credit evaluation shall be 100 points, and bonus points may be added at the same time, but the highest score shall not exceed 100 points.

  Article 11 The credit evaluation of the daily maintenance and traffic emergency service units shall be based on the evaluation unit of each maintenance project bid section under a separate contract, and the specific evaluation standard shall be implemented in accordance with the Annex Credit Evaluation Criteria for Industry Units. For the industry units with multiple bid sections, their scores are calculated by the inversely weighted average according to the rank of each bid section, and the scores of bad behavior and good behavior of the enterprises are directly added to or subtracted from the total scores, without adopting the inversely weighted average method.

  Deduction of points for bad behaviors of individual bid section (project): ;

  Where i is the number of bad behaviors and Ai is the deducted point corresponding to the bad behaviors.

  Score of individual bid section (project): ;

  Bid section (project) weighted score:

  Where i is the number of bid sections or projects in which the industry unit participates in the behavior evaluation of this municipal, i = 1, 2, … n, Li is the bad behavior score of the industry unit in a certain bid section or project, and Bi is the ranking of the bid sections or projects from high to low.

  Industry Unit Credit Score = Weighted Score of Bid Section (project)-Industry Unit Bad Behavior Score + Industry Unit Good Behavior Score

  The credit evaluation scoring standard shall be formulated and issued by the municipal traffic and transport management department, and shall be continuously improved according to the market needs.

  Article 12 The credit score of the maintenance bid section of the industry unit of traffic utility shall be divided into five grades: AA, A, B, C and D. The credit ratings corresponding to the ratings are:

  Grade AA: score ≥ 95, very good credit;

  Grade A: 85 ≤ score < 95, good credit;

  Grade B: 75 ≤ score < 85, average credit;

  Grade C: 60 ≤ score < 75, bad credit;

  Grade D: score < 60, very bad credit.

  Article 13 The industry units which enter the traffic facilities maintenance market of shenzhen for the first time shall be treated as Grade A credit, but if the unit has a bad credit record at or above the provincial level in the past three years and the circumstances are relatively minor, the unit shall be treated as Grade C credit, and the score shall be taken as the middle value of the grade score.

  Article 14 If any bad behavior in the Credit Evaluation Criteria for Industry Units of the Methods is directly assessed as Grade D, the credit rating of the industry unit in the current year shall be directly assessed as Grade D.

  Article 15 In principle, the validity period of the credit evaluation results shall be one year. If the industry units of traffic utility maintenance do not participate in the credit evaluation of the current year, the original credit evaluation grade may be extended for one year. If there is no credit evaluation result for more than two consecutive years, the credit rating shall be determined according to the initial entry into this municipal, but shall not be higher than the upper level of the original evaluation rating in this municipal.

  Article 16 If an industry unit changes its system or name, its credit rating shall be transferred to the enterprise that has changed its system or name accordingly. If an industry unit is cancelled or bankrupted, its credit rating shall be cancelled immediately. If the assets of an industry unit are frozen, its credit rating shall not be determined for the time being. After the assets are unfrozen, its credit rating shall be re-evaluated. If an enterprise's qualification is upgraded, its credit rating shall remain unchanged. Where an enterprise is divided, its credit rating shall be determined according to its initial entry into this municipal.

Chapter III Information Management and Results Application of Credit Evaluation Platform

  Article 17 The municipal traffic and transport administrative department shall collect, sort out and file the information of the credit evaluation platform according to law, and examine and verify the entered information at different levels to ensure the truthfulness and completeness of the credit information; carry out platform safety management to ensure platform operation safety and information safety; carry out interconnection and intercommunication with other relevant information platforms to achieve information sharing and timely update.

  Article 18 Priority shall be given to the industry units with high credit rating in the maintenance projects of traffic utility.

  Article 19 The credit rating results shall be taken as the basis for the credit rating of the tendering work of maintenance procurement. The project owner unit shall set credit scoring details when carrying out maintenance bidding qualification pre-examination or bidding evaluation, and carry out credit reward and punishment scoring according to the credit assessment results of the industry unit published at that time. Meanwhile, the evaluation (bid) committee and the project owner shall indicate the evaluation of credit rewards and penalties in the evaluation (bid) report.

  Article 20 During the tendering service period, for the tendering section of a daily industry unit whose credit rating has been rated as AA for more than two consecutive years, when the tendering service period expires and the tendering is reorganized, the unit may be preferentially selected in accordance with the provisions of the tendering documents.

  Article 21 During the tendering service period, the tendering section of a daily maintenance industry unit with a credit rating of Grade C for more than two consecutive years or Grade D for the current year may not be renewed in accordance with the tendering documents and the contract, and the procurement tendering work for the following year of the tendering section shall be reorganized.

  Article 22 During the tendering service period, a daily maintenance industry unit with a credit rating of Grade D may, in accordance with the tendering documents and the contract, terminate all its tendering contracts immediately without renewing the contract of the following year, and the procurement tendering work of the unit in the tendering section in the following year shall be reorganized.

  Article 23 The credit evaluation results may also be used in the supervision of the industry, the evaluation of the best quality, the pre-selection of contractors and other activities.

Chapter IV Supplementary Provisions

  Article 24 The Methods shall come into force as of August 1, 2019 and shall be valid for two years.
