Implementation Rules of the Interim Measures of Shenzhen Municipal on the Administration of the Subsidy Funds for the Construction of Green and Low-Carbon Port

Chapter I General Provisions

  Article 1 These Rules are formulated in accordance with the relevant provisions of the Interim Measures of Shenzhen Municipal on the Administration of the Subsidy Funds for the Construction of Green and Low-Carbon Port to further promote the construction of the green and low-carbon port in Shenzhen.

  Article 2 The Municipal Transport Commission shall be responsible for the acceptance and examination of applications for and issuance of subsidy funds for the construction of the green and low-carbon port.

  Article 3 The subsidy funds for the construction of green and low-carbon port mainly include:

  (1)Subsidy for shore power. The subsidy shall be provided for the fee for the construction of shore power facilities at the port, the fee for the reconstruction of shore power receiving facilities for ships, the demand charge for power supply of shore power facilities at the port, the test fee for the use of shore power after a ship's initial call at a port (hereinafter referred to as the "shore power test fee"), electricity price for shore power, the cost for the maintenance fees of shore power facilities, and the ship’s use of shore power;

  (2)Subsidy for clean-energy-powered ships. The subsidy shall be provided for the cost of construction or purchase of ships newly powered by clean energy such as natural gas and electric power.

  (3)Subsidy for ship’s exhaust purification facilities. The subsidy shall be provided for the cost for reconstruction of river-to-sea ships, port workboats and passenger ships installing emission purification facilities in line with the relevant Shenzhen standards;

  (4)Subsidy for online monitoring equipment for ship’s emission pollutants. The subsidy shall be provided for river-to-sea ships, port workboats and passenger ships installing online monitoring equipment for ship’s emission pollutants.

  Article 4 The applicant shall apply for subsidy funds by using Shenzhen Municipal Application System for Subsidy Funds for Construction of Green and Low-Carbon Port (hereinafter referred to as the application system).

  The applicant shall ensure that the materials submitted are true and accurate. The original subsidy application materials shall be kept for three years for verification by relevant departments.

  Article 5 All enterprises applying for subsidy funds shall apply to the Municipal Transport Commission for joining the Shenzhen Port Green Convention.

  Relevant enterprises and ships shall put on record the information in the application system and ensure the truthfulness and accuracy of the information put on record.

  Article 6 The port enterprise shall transmit the ship's berthing data to the application system as required, and shall ensure that the data are comprehensive, true and accurate.

Chapter II Standards and Applying of Subsidy

  Section 1 Subsidy for the Construction of Shore Power Facilities at the Port

  Article 7 The construction of shore power facilities at the port shall be subsidized at 30% of the project construction cost, and the value-added tax deduction shall not be deducted from the project construction cost.

  Article 8 The application for subsidy for the construction of shore power facilities at the port shall meet the following conditions:

  (1) The applicant shall be a port enterprise in Shenzhen;

  (2) The project shall be completed for acceptance after full load test and ship connection;

  (3) The applicant has signed the Commitment for Use of Shore Power.

  Article 9 Applicants who apply for subsidy for the construction of shore power facilities at the port shall submit their applications before the end of the year in which the project is completed, and submit the following materials:

  (1) Application Form for Subsidy Funds for Port Shore Power Facilities Construction Projects signed and sealed by the legal representative of the enterprise (see Annex 1 for details);

  (2) The feasibility study report of the project;

  (3) Supporting materials of project approval (approval documents of project approval, or resolutions of office meeting and minutes of meeting);

  (4) Supporting materials of project design (including the general budget estimate table in the engineering design document or the budget estimate table of the equipment installation project, etc.);

  (5) Supporting materials of project equipment purchase, including the purchase list of project equipment (see Annex 2 for details), equipment purchase contract and invoice for equipment purchase;

  (6) Supporting materials of project investment (including audit report of special final accounts);

  (7) Supporting materials of project completion time (including project completion acceptance documents).

  Section 2 Subsidy for the Reconstruction of Shore Power Receiving Facilities for Ships

  Article 10 The reconstruction of the shore power receiving facilities for ships shall be subsidized at 30% of the reconstruction cost of the project, and the value-added tax deduction shall not be deducted from the reconstruction cost of the project.

  Article 11 The following conditions shall be met in the application for subsidy for reconstruction of the shore power receiving facilities for ships:

  (1) The applicant shall be a shipping enterprise in Shenzhen;

  (2) The reconstructed ship shall be a Shenzhen-registered cargo transport ship;

  (3) The project has been completed and accepted;

  (4) The applicant has signed the Commitment for Use of Shore Power;

  (5) The reconstructed ship has already used shore power in Shenzhen Port.

  Article 12 Applicants who apply for subsidy for the reconstruction of the shore power receiving facilities for ships shall file an application before the end of the year in which the project is completed, and submit the following materials:

  (1) Application Form for Subsidy Funds for Reconstruction of Shore Power Receiving Facilities for Ships signed and sealed by the legal representative of the shipping enterprise (see Annex 3 for details);

  (2) The feasibility study report of the project;

  (3) Supporting materials of project approval (approval documents of project approval, or resolutions of office meeting and minutes of meeting);

  (4) Supporting materials of project design (including the general budget estimate table in the engineering design document or the budget estimate table of the equipment installation project, etc.);

  (5) Supporting materials of project equipment purchase, including the purchase list of project equipment (see Annex 2 for details), equipment purchase contract and invoice for equipment purchase;

  (6) Supporting materials of project investment (including audit report of special final accounts);

  (7) Supporting materials of project completion time (including project completion acceptance documents);

  (8) Supporting materials of the applicant ship having used shore power in Shenzhen Port.

Section III Subsidy for Demand Charge for Power Supply of Shore Power Facilities at the Port

  Article 13 The demand charge for power supply of shore power facilities at the port shall be subsidized in full according to the actual situation.

  Article 14 The application for the subsidy for demand charge for power supply of shore power facilities at the port shall meet the following conditions:

  (1) The applicant shall be a port enterprise in Shenzhen;

  (2) The port enterprise applying for the demand charge for power supply of shore power facilities at the port shall use the shore power not less than 3 times per quarter.

  Article 15 Where an applicant applies for the subsidy for demand charge for power supply of shore power facilities at the port, he/she shall submit application for the previous quarter before the end of January, April, July and October, and submit the relevant supporting documents for the settlement of demand charge for power supply issued by the power supply company, and shall submit supplementary explanatory documents in case of other circumstances.

  Section 4 Subsidy for Shore Power Test Fee

  Article 16 Where an ocean-going ship connects with the shore power facilities of a Shenzhen port enterprise for the first time and successfully uses the shore power, it shall be given a subsidy of RMB 30,000 per ship for the shore power test fee of the port enterprise.

  If the same ship connects the shore power facilities for the first time in different port enterprises and successfully uses the shore power, each port enterprise may apply for the subsidy of the shore power test fee.

  Article 17 Applicants who apply for the subsidy of shore power test fee shall submit their applications for the previous quarter before the end of January, April, July and October, and submit the following materials:

  (1) The specific information of the ship connected to the shore power;

  (2) Ship test data and image data;

  (3) The electricity bill confirmed by the shipping enterprise.

  Article 18 For shore power test, the applicant may apply for subsidy for electricity price of shore power, subsidy for maintenance fees of shore power facilities and subsidy for ship’s use of shore power, in addition to the subsidy for shore power test fee.

  Article 19 During shore power test, ships must abide by the relevant provisions of the emission control zone. If they fail to use shore power within the specified time, they must use low-sulfur fuel oil that meets the requirements.

  Section 5 Subsidy for Electricity Price of Shore Power

  Article 20 The subsidy for electricity price of shore power shall be subsidized in full in accordance with the difference between the contract price of power supply for the port enterprise and the government guided prices.

  Article 21 The government guided prices include general prices and special prices.

  For ships using shore power during the berthing period, the government shall guide the general price, which shall not be less than RMB 0.3 /kW•h.

  The special price guided by the government shall be applied to the ships that sign the Commitment for Use of Shore Power and promise to use shore power every time they call at the same port enterprise without endangering the safety of the ships.

  Article 22 The calculation formula for the general price guided by the government shall be:

  P electricity = P oil × 0. 00031 ton/ kW•h × E × A

  P electricity: government guided general price in RMB/ kW•h;

  P oil: average price of Singapore marine diesel oil (MDO) in USD/ton in the previous month;

  E: exchange rate of RMB against USD, which shall be determined according to the monthly average conversion price of the foreign exchange quotation of the Bank of China for the previous month, and the unit is RMB/USD;

  A: Subsidy factor, 30% from September 22, 2017 to December 5, 2018; 40% from December 6, 2018 to December 5, 2019; 50% from December 6, 2019 to December 5, 2020.

  Article 23 The formula for calculating the government guided special price shall be:

  Government guided Special Price = Government guided General Price-RMB 0.1/kW•h.

  Article 24 The Municipal Transport Commission shall publish the government guided prices for the current month in the application system before the 5th day of each month.

  Article 25 The following conditions shall be met in the application for subsidy for electricity price of shore power:

  (1) The applicant shall be a port enterprise in Shenzhen;

  (2) The price of the shore power supply for port enterprises shall not be higher than the price guided by the government in the current month.

  Article 26 Applicants who apply for subsidy for electricity price of shore power shall submit their applications for the previous quarter before the end of January, April, July, and October, and submit the following materials:

  (1) The electricity bill confirmed by the shipping enterprise;

  (2) The starting and ending kW•h of the shore power meter;

  (3) Supporting materials of current electricity price of the power supply company.

  Article 27 The amount of electricity used by the shore power shall be measured by the meter of the shore power facilities of the port enterprise.

  Section 6 Subsidy for Maintenance Fees of Shore Power Facilities

  Article 28 The subsidy for the maintenance fees of shore power facilities shall be correspondingly subsidized according to the use of shore power by port enterprises.

  Article 29 The utilization rate of shore power of ocean-going ships of a port enterprise refers to the proportion of ocean-going ships using shore power used by the port enterprise each quarter to the number of ocean-going ships berthed by the enterprise during the same period.

  Article 30 The number of ocean-going ships using shore power and the power consumption of the port enterprise each quarter shall be subject to the corresponding data of the application for subsidy for electricity price of shore power by the port enterprise in the same period.

  Article 31 Port enterprises of Shenzhen Municipal may apply for subsidy for maintenance fees of shore power facilities.

  Article 32 Applicants who apply for subsidy for maintenance fees of shore power facilities shall submit their applications for the previous quarter before the end of January, April, July, and October.

  Section 7 Subsidy for the Use of Shore Power for Ships

  Article 33 The subsidy for the use of shore power for ships shall be given in accordance with the use of shore power by shipping enterprises.

  Article 34 The utilization rate of shore power of ocean-going ships of a shipping enterprise refers to the proportion of ships using shore power used by the shipping enterprise around the whole year in the total number of ships berthed by the enterprise in the whole territory. Ships include owned and chartered ships.

  If two or more port enterprises are berthed on the same voyage, each port enterprise berthed shall be counted as one ship.

  Article 35 Applicants who apply for subsidy for the use of shore power for ships shall submit their applications for the previous year before January 31 of each year.

  In principle, the number of ships using shore power and the amount of electricity consumed by the shipping enterprises in the port throughout the year shall be subject to the number of ships applying for subsidy for electricity price of shore power. If there are any ships not applying for subsidy for electricity price of shore power, the shipping enterprises shall submit the following materials:

  (1) Relevant information on the use of shore power by ships;

  (2) A certified copy of the engine room log signed by the chief engineer and stamped with the seal of the ship showing the use of shore power by the ship;

  (3) The electricity bill confirmed by both the port and the shipping enterprise.

  Section 8 Subsidy for Clean-energy-powered Ships

  Article 36 The subsidy for clean-energy-powered ships shall be 30% of the engine cost of the ship purchased or constructed, and the maximum subsidy for each ship shall not exceed RMB 15 million.

  The cost of the engine shall be subject to the supporting materials issued by the shipyard.

  Article 37 The application for subsidy for clean-energy-powered ships shall meet the following conditions:

  (1) The applicant shall be an enterprise in Shenzhen and the owner of the ship;

  (2) The port of registry of the ship is Shenzhen;

  (3) The ships purchased and built use clean energy power such as natural gas or electric power;

  (4) The applicant shall promise that the ship shall serve the Shenzhen Port throughout the life cycle.

  Article 38 Applicants who apply for subsidy for clean-energy-powered ships shall apply before the end of the year in which the ships are registered, and submit the following materials:

  (1) Business license of the enterprise;

  (2) Certificate of registration of the ship;

  (3) Contracts for the purchase (construction) of ships;

  (4) Invoices for the purchase (construction) of ships;

  (5) Supporting materials of engine cost issued by the shipyard;

  (6) Supporting materials of ship being powered by natural gas or electric power;

  (7) A Letter of Commitment for Serving Shenzhen Port during the Life Cycle.

  Section 9 Subsidy for Ship’s Exhaust Purification Facilities

  Article 39 Subsidy for ship’s exhaust purification facilities shall be subsidized at 50% of the installation and reconstruction expenses of the ship’s exhaust purification facilities.

  The installation and reconstruction expenses include the expenses of ship’s exhaust purification facilities, installation expenses and the expenses of ship reconstruction for installation of ship’s exhaust purification facilities.

  Article 40 The application for the subsidy for ship’s exhaust purification facilities shall meet the following conditions:

  (1) The applicant shall be an enterprise in Shenzhen and the owner or operator of the ship;

  (2) The port of registry of the ship is Shenzhen;

  (3) The ships are river-to-sea ships, port workboats and passenger ships;

  (4) The project has been accepted.

  Article 41 Applicants who apply for subsidy for ship’s exhaust purification facilities shall file an application before the end of the year in which the facilities are inspected and accepted, and submit the following materials:

  (1) Business license of the enterprise;

  (2) Certificate of registration of the ship;

  (3) Relevant contracts for the installation and reconstruction of exhaust purification facilities;

  (4) Project acceptance data, including design scheme of ship’s exhaust purification facilities, completion acceptance report, exhaust emission inspection report, etc.

  Section 10 Subsidy for Online Monitoring Equipment for Ship’s Emission Pollutants

  Article 42 Subsidy for online monitoring equipment for ship’s emission pollutants shall be subsidized at 50% of the cost of online monitoring equipment.

  The cost of online monitoring equipment includes the cost of online monitoring equipment, installation cost and the cost of ship reconstruction for installation of online monitoring equipment.

  Article 43 The application for the subsidy of online monitoring equipment for ship’s emission pollutants shall meet the following conditions:

  (1) The applicant shall be an enterprise in Shenzhen and the owner or operator of the ship;

  (2) The port of registry of the ship is Shenzhen;

  (3) The ships are river-to-sea ships, port workboats and passenger ships;

  (4) The online monitoring equipment meets the requirements of relevant Shenzhen standards and is networked with maritime or environmental protection departments;

  (5) The project has been accepted.

  Article 44 Applicants who apply for subsidy for online monitoring equipment for ship’s emission pollutants shall file an application before the end of the year in which the online monitoring equipment is checked and accepted, and submit the following materials:

  (1) Business license of the enterprise;

  (2) Certificate of registration of the ship;

  (3) Contract and invoice for online monitoring equipment for ship’s emission pollutants;

  (4) Project acceptance materials, including completion acceptance report and online monitoring of equipment operation, etc.

Chapter III Examination, Approval and Issuance of Subsidy

  Article 45 The applicant shall submit the application for subsidy within the prescribed time limit. If it is necessary to supplement the application materials, the application shall be submitted within 5 working days after the notification by the Municipal Transport Commission.

  Article 46 For applications other than subsidy for ship’s exhaust purification facilities and subsidy for online monitoring equipment for ship’s emission pollutants, the Municipal Transport Commission shall, within 15 working days, examine and verify the materials submitted by the applicants for subsidy funds, and shall not pass the applications if they do not meet the requirements of the application and explain the reasons therefor; if the applicant meets the requirements for application, the Municipal Transport Commission shall issue opinions on the examination and approval of the subsidy.

  The Municipal Transport Commission shall, within 15 working days after accepting the application for the subsidy for ship’s exhaust purification facilities, organize an expert review meeting with the Human Settlements and Environment Commission of Shenzhen Municipal to conduct on-site inspection, review, and acceptance. If the application conditions are not met, the project review and acceptance shall not be passed and the reasons shall be explained; if the applicant meets the requirements for application and passes the examination and acceptance by the experts, the Municipal Transport Commission shall issue opinions on the examination and approval of the subsidy.

  The Municipal Transport Commission shall, within 15 working days after accepting the application for the subsidy of online monitoring equipment for ship’s emission pollutants, organize an expert review meeting in conjunction with the Human Settlements and Environment Commission of Shenzhen Municipal and Shenzhen Maritime Safety Administration to conduct on-site inspection, review, and acceptance. If the application conditions are not met, the project review and acceptance shall not be passed and the reasons shall be explained; if the applicant meets the requirements of the application and passes the examination and acceptance by the experts, the municipal transportation committee and the municipal human settlements environment committee shall jointly issue the opinions on the examination and approval of the subsidy.

  Article 47 The opinions on the examination and approval of financial aid shall be published on the website of the Municipal Transport Commission within a period of 15 working days.

  Article 48 If there is no objection after the expiration of the publicity period, the Municipal Transport Commission shall, in accordance with the relevant provisions on budget preparation, incorporate it into the departmental budget of the following year, and after the approval of the departmental budget of the following year is issued, the Municipal Transport Commission shall allocate the corresponding subsidy funds.

  In case of any objection, the objector may apply to the Municipal Transport Commission for reexamination, and the Municipal Transport Commission shall reexamine the application and reissue the opinions on the examination of financial aid according to the reexamination results and publicize them.

Chapter IV Supervision and Administration

  Article 49 The shipping enterprise to which the ship belongs shall make a written explanation to the municipal Transport Commission if the ship signing the Commitment for Use of Shore Power fails to use the shore power due to the danger to the safety of the ship and the inability of the port enterprise to provide the shore power service.

  Article 50 The Municipal Finance Committee shall supervise and inspect the use of subsidized funds in accordance with the laws, and shall carry out key performance evaluation or re-evaluation according to needs, and all relevant units shall actively cooperate with it.

  Article 51 The applicant enterprise shall cooperate with the supervision and inspection of various government departments of Shenzhen Municipal and submit relevant materials as required.

  Article 52 These rules shall be interpreted by the Municipal Transport Commission.

  Article 53 These Rules shall enter into force as of June 15, 2018, and shall remain in force until December 5, 2020. Subsidy from September 22, 2017 to the date of implementation of these Rules shall be implemented with reference to these Rules.
