　　In accordance with Notice of Shenzhen Municipal People's Government on Printing and Distributing the Sustainable Action Plan of 2018 “Shenzhen Blue” (SFBG (2018) No. 6), Notice of Shenzhen Housing and Construction Bureau, Shenzhen Transport Commission and Human Settlements and Environment Commission of Shenzhen Municipal on Printing and Distributing the Work Plan for Renovation and Reconstruction of Dumpers, Mixers and Non-road Mobile Construction Machinery of Shenzhen Municipal (SJFG (2018) No. 23), and other relevant requirements, we have formulated the Measures of Shenzhen Municipal on Subsidy for the Elimination of Traditional Dumpers, which is hereby printed and implemented. Please abide by the Measures.

Measures of Shenzhen Municipal on Subsidy for the Elimination of Traditional Dumpers

Chapter I General Provisions

　　Article 1 For the purpose of comprehensively improving the safety management level of dumpers and enhancing the quality of the atmospheric environment, and speeding up the popularization and application of the new type of fully enclosed intelligent dumpers in this municipal, the Measures is formulated in accordance with the Work Plan for Renovation and Reconstruction of Dumpers, Mixers and Non-road Mobile Construction Machinery of Shenzhen Municipal deliberated and adopted by the Municipal Government, and in combination with the arrangements of the Sustainable Action Plan of “Shenzhen Blue”.

　　Article 2 The term "traditional dumper" as mentioned in the Measures refers to a traditional open dump truck with three axles or more engaged in the transportation of construction waste, sand and gravel and other engineering bulk materials in this municipal. In addition, the vehicles shall obtain the motor vehicle license plate registered by the municipal public security traffic management department according to law, and apply for the valid Road Transport Certificate and the “file license plate” with normal qualification issued by the municipal competent traffic and transport department according to the requirements; meanwhile, the vehicle should have installed the GPS terminal in normal operation according to the requirements of the transportation department, and the data should be connected to the dumper monitoring platform.

　　The traditional dumpers include the traditional fuel-powered dumpers with the traditional fuel as the main power (not including the gasoline trucks with the pollutant emission not up to the national standard Ⅰ and the diesel trucks with the pollutant emission not up to the national standard Ⅲ, namely the yellow label vehicle) and the traditional LNG dumpers with the natural gas as the main power.

　　Article 3 The term "elimination" as mentioned in the Measures refers to the self-disposal of traditional dumpers by scrapping and transferring them. Scrap refers to the sale of traditional dumpers to qualified enterprises recycling scrapped motor vehicle for dismantling and scraping disposal; transfer refers to the removal of the traditional dumpers from the administrative area of this municipal (including Shenzhen-Shantou Cooperation Zone), the transfer formalities of the vehicle shall be handled and the vehicle shall be registered in the public security traffic management department in a different place (the vehicle shall be registered with a non-Yue B license plate).

　　The term "elimination subsidy" as mentioned in the Measures refers to the issuance of qualified vehicle elimination subsidy and incentive funds by the municipal transportation department to the vehicle owners.

Chapter II Scope and Standards of Subsidy

　　Article 4 The traditional dumpers applying for elimination subsidy shall meet the following conditions:

　　(1) The initial registration time of vehicles shall be on or after August 6, 2004 (six-axle trains shall be subject to the initial registration time of heavy-duty tipping semi-trailer), and the service life shall be at least one year earlier than the national compulsory scrapping standard (including one year).

　　(2) Scrapped vehicles shall obtain the Certificate of Cancellation of Motor Vehicles issued by the municipal public security traffic management department.

　　(3) The transfer vehicle has gone through the formalities for transfer registration endorsement of the Certificate of Registration of Motor Vehicles, and the "name of the vehicle management office of the transfer-in place" in the information specified in the registration column of the Certificate of Registration of Motor Vehicles is a vehicle management office in a different place, and the vehicle license plate is a non-Yue B license plate.

　　Article 5 The subsidy standards for the elimination of traditional fuel-powered dumpers in this municipal are as follows:

　　Article 6 The subsidy standards for elimination of traditional LNG type dumpers in this municipal are as follows:

　　Article 7 In order to encourage the elimination of traditional dumpers, on the basis of the subsidy standards in Article 5 and 6 of the Measures, certain rewards shall be given to vehicles that are scrapped and transferred earlier. Specific reward criteria are:

　　(1) Vehicles that have completed the elimination between August 6, 2018 (inclusive) and October 31, 2018 (inclusive) and have submitted their applications within the acceptance time shall be subsidized at 124% of the subsidy standard of Article 5 and 6.

　　(2) Vehicles that have completed the elimination between November 1, 2018 (inclusive) and November 30, 2018 (inclusive) and have submitted their applications within the acceptance time shall be subsidized at 120% of the subsidy standards of Article 5 and 6.

　　(3) Vehicles that have completed the elimination between December 1, 2018 (inclusive) and December 31, 2018 (inclusive) and have submitted their applications within the acceptance time shall be subsidized at 116% of the subsidy standard of Article 5 and 6.

　　(4) Vehicles that have completed the elimination between January 1, 2019 (inclusive) and January 31, 2019 (inclusive) and have submitted their applications within the acceptance time shall be subsidized at 112% of the subsidy standard of Article 5 and 6.

　　(5) Vehicles that have completed the elimination between February 1, 2019 (inclusive) and February 28, 2019 (inclusive) and have submitted their applications within the acceptance time shall be subsidized at 108% of the subsidy standard of Article 5 and 6.

　　(6) Vehicles that have completed the elimination between March 1, 2019 (inclusive) and March 31, 2019 (inclusive) and have submitted their applications within the acceptance time shall be subsidized at 104% of the subsidy standard of Article 5 and 6.

　　(7) Vehicles that have completed the elimination between April 1, 2019 (inclusive) and May 31, 2019 (inclusive) and have submitted their applications within the acceptance time shall be subsidized at 100% of the subsidy standard of Article 5 and 6.

Chapter III Application Time and Examination Procedures

　　Article 8 The elimination period of the traditional dumpers elimination subsidy shall be from August 6, 2018 (inclusive) to May 31, 2019 (inclusive). Of which:

　　(1) The elimination time of scrapped vehicles shall be subject to the "cancellation date" specified in the Certificate of Cancellation of Motor Vehicles.

　　(2) The elimination time of the transferred vehicles shall be subject to the date of the transfer registration endorsed on the Certificate of Registration of Motor Vehicles when it was transferred from Shenzhen for the last time.

　　Article 9 The acceptance time of the elimination subsidy for traditional dumpers shall be from the date of promulgation of the Measures to September 30, 2019 (inclusive).

　　Article 10 The application for elimination subsidy shall be submitted with the following materials or information:

　　(1) Certificate of Cancellation of Motor Vehicles or Certificate of Registration of Motor Vehicles, the original of which shall be scanned and uploaded.

　　(2) Application Form of Shenzhen Municipal for Subsidy for the Elimination of Traditional Dumpers to be filled online.

　　(3) The uniform social credit code or organization code of the applicant enterprise shall be filled in the application form online.

　　(4) To apply for an enterprise bank account (the information of the deposit bank and the sub-branch shall be provided if the account is required to be opened in this municipal. The name of the account or account number is consistent with the registered name of the vehicle and the account is in the normal state), the application form shall be filled online.

　　(5) Commitment of Shenzhen Municipal on the Issuance of Subsidy Funds for the Elimination of Traditional Dumpers, the original of which shall be scanned and uploaded.

　　Article 11 Subsidy Application Procedures:

　　(1) Preparation for declaration.

　　1. Scrapped vehicles: traditional dumpers shall be sold to qualified scrapped vehicle recycling enterprises, and the recycling enterprises shall submit the scrapped vehicle information to the municipal public security traffic management department, which shall examine and verify the cancellation procedures and issue the Certificate of Cancellation of Motor Vehicles;

　　2. Transferred vehicles: go through the formalities of endorsement for the transfer and transfer-in registration of the Certificate of Registration of Motor Vehicles at the public security traffic management department of this municipal and the place where they move in.

　　(2) Online declaration.

　　1. The applicant shall log in to the Shenzhen Municipal Management System for Subsidy for Elimination of Traditional Dumpers (hereinafter referred to as the subsidy system), fill in the Application Form of Shenzhen Municipal for Subsidy for the Elimination of Traditional Dumpers online, and print, sign and affix the official seal;

　　2. Download the Commitment of Shenzhen Municipal on the Issuance of Subsidy Funds for the Elimination of Traditional Dumpers on the subsidy system, and print, sign and affix the official seal;

　　3. Upload to the subsidy system the Certificate of Cancellation of Motor Vehicles or Certificate of Registration of Motor Vehicles specified in Article 10 of the Measures, as well as the Application Form of Shenzhen Municipal for Subsidy for the Elimination of Traditional Dumpers and the scanned Commitment of Shenzhen Municipal on the Issuance of Subsidy Funds for the Elimination of Traditional Dumpers.

　　(3) Acceptance and examination.

　　1. The subsidy system automatically compares the vehicle information, verifies whether the application materials are complete, and automatically accepts the applications with complete materials;

　　2. The municipal public security traffic management department shall complete the examination and verification of vehicle cancellation and off-site endorsement within 10 working days;

　　3. The municipal transportation department shall complete the examination of the application materials within 5 working days after the municipal public security traffic management department completes the examination of vehicle cancellation and off-site endorsement.

　　(4) Announcement.

　　The municipal transportation department shall public the relevant information of qualified vehicles within 5 working days after the completion of the examination and verification.

　　(5) Issuance.

　　1. The municipal transportation department shall allocate the subsidy fund to the owner of the vehicle without objection within 5 working days after the announcement;

　　2. The municipal transportation department shall cancel the "file number plate" of the subsidized vehicles uniformly, and the applicant enterprise shall apply for cancellation or removal of the Road Transport Certificate within 15 working days after receiving the subsidized funds.

　　Article 12 If there is any objection to the ownership of a vehicle, an application for objection may be filed with the municipal transportation department within the period of publicity. Objection application shall be submitted with vehicle purchase invoice, bank loan certificate, cooperative operation contract (indicating vehicle ownership) and other supporting materials.

　　Article 13 The application procedures for objections to the ownership of a vehicle shall be as follows:

　　(1) The objecting applicant shall go to the acceptance point for objecting to the ownership of the traditional dumpers entitled to elimination subsidy set up by the municipal transportation department, and submit the objecting application and relevant supporting materials.

　　(2) The municipal transportation department shall suspend the issuance of elimination subsidy funds for the dissenting vehicles within 2 working days after accepting the valid objection application.

　　(3) If both parties resolve the dispute through consultation by themselves, the objecting party shall go to the acceptance point for objecting to the ownership of the traditional dumpers entitled to elimination subsidy to submit the objection revocation application, and the municipal transportation department shall allocate the subsidy fund to the owner within 5 working days after receiving the revocation application.

　　(4) Any party shall submit the right confirmation document issued by the judicial or arbitral organ to the municipal transportation department. If the ascertainer of the right of the vehicle is consistent with the applicant, the subsidy shall be paid to the applicant; if the ascertainer of the right of the vehicle is inconsistent with the applicant, the ascertainer of the right of the vehicle shall make a new application.

Chapter IV Division of Responsibilities

　　Article 14 The municipal dumper renovation office shall be responsible for coordinating the elimination subsidy for traditional dumpers and making decisions on difficult issues concerning subsidies.

　　Article 15 The municipal transportation department shall be responsible for organizing and implementing the Measures, carrying out qualification certification of the traditional dumpers conforming to the Measures, and making statistics on the electronic data of the list of traditional dumpers conforming to the Measures, establishing a management system for subsidy for elimination of traditional dumpers, examining the application data and allocating the subsidy to the owner, cancelling or removing Road Transport Certificate, and cancelling “file number plate”.

　　Article 16 The municipal environmental protection department shall be responsible for providing the municipal transportation department with the electronic data of the traditional dumpers that has applied for the reward subsidy for the early elimination of old vehicles in this municipal.

　　Article 17 The municipal financial department shall be responsible for raising and implementing the subsidy funds, ensuring the steady implementation of the subsidy work, and reevaluating the fund performance in accordance with regulations.

　　Article 18 The municipal economic and trade information department shall be responsible for supervising the enterprises recycling scrapped motor vehicles to do a good job in the scrapping and recycling of traditional dumpers and establishing green channels. It shall be responsible for reviewing and issuing the Certificate for Recycling Scrapped Automobiles, supervising and urging the enterprises recycling scrapped motor vehicles to do a good job in service, guiding the enterprises dismantling scrapped vehicles to improve service quality and efficiency, and facilitating car delivery or other relevant formalities.

　　Article 19 The municipal public security traffic management department shall be responsible for the registration of eliminated vehicles and the establishment of green channels, carrying out cancellation procedures for the vehicles applying for scrapping, and issuing the Certificate of Cancellation of Motor Vehicles, taking back the local license plate and the Driving Permit of the motor vehicles for vehicles applying for transfer, handling the transfer formalities of the Certificate of Registration of Motor Vehicles, examining the endorsement of the Certificate of Registration of Motor Vehicles of the transferred vehicle in different places, cancelling the temporary pass of the scrapped or transferred vehicles, and providing the electronic data of the vehicles.

Chapter V Supervision and Administration

　　Article 20 Units and individuals who misappropriate or defraud subsidy funds shall be dealt with by the relevant departments in accordance with the Regulations on Punishment and Penalty of Financial Violations (Decree No. 427 of the State Council) and other relevant regulations, and shall be transferred to the judicial organs if the case constitutes a crime.

　　Article 21 In violation of the Measures, those who fail to perform their duties conscientiously and make mistakes in fund management or accept bribes from others by taking advantage of their positions shall be dealt with by the municipal finance and supervision departments in accordance with the limits of authority stipulated in the Regulations on Punishment and Penalty of Financial Violations and the Provisional Measures of Shenzhen Municipal on Investigating the Administrative Fault Liability of Staff of Administrative Organs. If the case constitutes a crime, it shall be transferred to a judicial organ for handling.

　　Article 22 Any enterprise that fails to fulfill its commitment to issue subsidy funds for the elimination of traditional dumpers, or has serious consequences due to the dispute over the ownership of vehicles, shall be investigated and dealt with by the municipal transportation department according to law, and its qualifications for meeting the standards shall be revoked according to law.

Chapter VI Supplementary Provisions

　　Article 23 Traditional dumpers that have applied for the reward subsidy for early elimination of old vehicles in accordance with the Measures of Shenzhen Municipal on Reward Subsidy for Early Elimination of Old Vehicles (2018-2020) shall not participate in the subsidy for early elimination of traditional dumpers.

　　Article 24 The Municipal Transport Commission shall be responsible for the interpretation of the Measures.

　　Article 25 These Measures shall come into force as of November 19, 2018 and shall remain in force until October 31, 2020.
